1. What ClearPath is (and is not)

ClearPath is an online document preparation service. We help you understand immigration forms and prepare documents for submission to the United States Citizenship and Immigration Services (USCIS) and related agencies.

ClearPath IS:

• A document preparation service similar to LegalZoom or Boundless
• A tool to help you understand immigration forms in plain English
• A service that generates personalized document checklists based on your situation
• A guide to help you organize and prepare your immigration application

ClearPath is NOT:

• A law firm or attorney
• A provider of legal advice
• A guarantee of immigration approval
• A substitute for an immigration attorney in complex cases
• Affiliated with or endorsed by USCIS or any government agency

Nothing on ClearPath constitutes legal advice. The information provided is for general educational purposes only. Immigration law is complex and changes frequently, always verify current requirements at uscis.gov before filing.

2. Who can use ClearPath

You must be at least 18 years old to use ClearPath. By using our service, you represent that you are 18 or older and have the legal capacity to enter into this agreement.

ClearPath is intended for use by individuals preparing their own immigration documents. You may not use ClearPath to prepare documents for others for compensation unless you are a licensed immigration attorney or accredited representative.

3. Your responsibilities

By using ClearPath, you agree to:

• Provide accurate information. You are responsible for the truthfulness and accuracy of all information you enter. Providing false information to USCIS is a federal crime.
• Review everything before filing. You must carefully review all documents generated by ClearPath before submitting them to USCIS. You are solely responsible for what you submit.
• Verify current requirements. USCIS fees, addresses, and form editions change. Always verify at uscis.gov before mailing your application.
• Seek legal counsel when needed. If your situation is complex, prior deportation, criminal history, visa violations, or prior denials, consult a licensed immigration attorney.
• Not misuse the service. You may not use ClearPath for any unlawful purpose or to prepare fraudulent immigration documents.

4. Payments and refunds

Fees: ClearPath charges a one-time fee per document package. All fees are stated clearly before payment. There is no subscription or recurring charge. Fees do not include USCIS government filing fees, which you pay separately directly to USCIS.

Refund policy: We offer a full refund within 24 hours of purchase if you have not yet downloaded your document package. After downloading your package, refunds are issued at our discretion. To request a refund, email support@getclearpath.xyz within 24 hours of purchase.

What we don't refund: USCIS filing fees, any costs you incur as a result of using our documents, or fees paid more than 24 hours ago after package download.

Payments are processed securely by Stripe. We never store your payment information.

5. Accuracy of information

ClearPath uses AI technology to generate document checklists and case summaries. While we work hard to keep our information accurate and up to date, we make no warranties, express or implied, about the completeness, accuracy, or fitness for purpose of any information provided.

Immigration law changes frequently. USCIS form editions, filing fees, and mailing addresses are updated regularly. ClearPath cannot guarantee that all information is current at the time of your filing. Always verify requirements at uscis.gov before submitting.

ClearPath is not responsible for any USCIS rejections, delays, denials, or other outcomes related to your immigration application, whether or not you used our service to prepare your documents.

6. Limitation of liability

To the maximum extent permitted by law, ClearPath and its owners, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our service, including but not limited to:

• USCIS rejection, denial, or delay of your immigration application
• Errors or inaccuracies in documents you prepare using ClearPath
• Any immigration consequences resulting from your use of our service
• Loss of data or inability to access the service

Our total liability to you for any claim arising from your use of ClearPath shall not exceed the amount you paid us in the 3 months prior to the claim.

7. Intellectual property

All content on ClearPath, including our wizard, question flow, design, text, and AI-generated guidance, is owned by ClearPath and protected by copyright. You may not copy, reproduce, or resell any part of our service without written permission.

The documents we help you prepare (your actual filled forms and checklists) belong to you. We claim no ownership over your personal immigration documents.

8. Termination

We reserve the right to suspend or terminate your access to ClearPath at any time if we believe you are violating these terms, misusing the service, or using it for fraudulent purposes. If we terminate your account without cause, we will issue a full refund of any unused services.

9. Disputes

These Terms are governed by the laws of the State of Texas. Any disputes arising from your use of ClearPath shall first be attempted to be resolved through good faith negotiation. If we cannot resolve a dispute informally, it shall be submitted to binding arbitration in Texas under the rules of the American Arbitration Association.

You agree to resolve disputes with ClearPath individually and not as part of a class action.
