Biometrics appointment
USCIS schedules your spouse for fingerprinting at a local Application Support Center. Bring the I-797 receipt notice and photo ID.
6-12 weeks after filing
Work permit (EAD) and travel doc arrive
Your spouse can start working legally and travel internationally once these arrive. Usually processed faster than the I-485.
3-7 months after filing
Interview notice

Can my spouse work while the I-485 is pending? βΊ
Yes , but only after their Employment Authorization Document (EAD) arrives. Filing I-765 with your I-485 package starts this process. The EAD typically arrives 3-5 months after filing. Your spouse cannot work legally until it arrives, even if the I-485 itself is still pending.
Can my spouse travel internationally while I-485 is pending? βΊ
Only with Advance Parole (Form I-131). Filing I-131 with your package is critical. Leaving the US without Advance Parole while I-485 is pending is treated as abandoning the application , USCIS will close your case and your spouse would have to start over from outside the country.
What is the difference between I-485 and consular processing? βΊ
Consular processing is for spouses outside the US , they apply for an immigrant visa at a US Embassy abroad and enter the US as a permanent resident. Adjustment of status (I-485) is for spouses already inside the US , they apply to change their status to permanent resident without leaving. I-485 has higher government fees ($1,440 vs $675) but avoids the visa interview abroad and keeps your spouse in the US throughout the process.
Do both spouses attend the I-485 interview? βΊ
Yes. Unlike consular processing where only the spouse attends, adjustment of status interviews require both the US citizen petitioner and the foreign national spouse to appear together at a local USCIS field office. What if my spouse overstayed a visa before we got married? βΊ
Immediate relatives of US citizens (including spouses) are generally not subject to the 3-year and 10-year bars for visa overstays when adjusting status inside the US.
