⚠️
Important , do not travel while your I-485 is pending
Once you file I-485, your spouse cannot leave the US without Advance Parole (Form I-131). Leaving without it will abandon the application. ClearPath walks you through filing I-131 at the same time as I-485.
WHAT YOU ARE FILING

6 forms. One package. Filed together.

Adjustment of status is unlike any other immigration filing. All 6 forms go in one envelope to USCIS. ClearPath covers every single one.

FORM I-485
Application to Register Permanent Residence
The main form. 18 pages. Every section matters. This is the application that grants your spouse permanent resident status.
USCIS fee: $1,140
FORM I-765
Employment Authorization
Allows your spouse to work legally in the US while the I-485 is pending. Takes 3-5 months to process separately.
USCIS fee: $260
FORM I-131
Advance Parole (Travel Document)
Allows your spouse to travel outside the US while I-485 is pending. Without this, leaving the country abandons the application.
USCIS fee: Included with I-485
FORM I-864
Affidavit of Support
Proves you earn at least 125% of the poverty line for your household size. One of the most common RFE triggers.
No fee
FORM I-693

Must be completed by a USCIS-approved civil surgeon in the US. Sealed envelope. Valid for 4 years.
Civil surgeon fee: $200-500
FORM I-130

WHAT HAPPENS AFTER YOU FILE

Your adjustment of status timeline

Once your package is mailed to USCIS, here is exactly what happens and when.

Package mailed to USCIS lockbox
Mail everything in one envelope via certified mail. Keep your tracking number , this is your proof of filing.
Day 1
2
Receipt notices (I-797) received
USCIS sends a separate receipt notice for each form filed , I-485, I-765, I-131. Each has its own receipt number for tracking.
2-4 weeks after mailing
3
Biometrics appointment
USCIS schedules your spouse for fingerprinting at a local Application Support Center. Bring the I-797 receipt notice and photo ID.
6-12 weeks after filing
4

Your spouse can start working legally and travel internationally once these arrive. Usually processed faster than the I-485.
3-7 months after filing

8-18 months after filing
βœ“
Green card approved

10-18 months total
"Adjustment of status is the path my wife would have taken if she were already in the US. The I-485 package is actually more complex than consular processing because you are filing 6 forms at once. I built this guide so every family knows exactly what to send, when to send it, and what happens after."

COMMON QUESTIONS
Can my spouse work while the I-485 is pending? β€Ί
Yes , but only after their Employment Authorization Document (EAD) arrives. Filing I-765 with your I-485 package starts this process. The EAD typically arrives 3-5 months after filing. Your spouse cannot work legally until it arrives, even if the I-485 itself is still pending.
Can my spouse travel internationally while I-485 is pending? β€Ί
Only with Advance Parole (Form I-131). Filing I-131 with your package is critical. Leaving the US without Advance Parole while I-485 is pending is treated as abandoning the application , USCIS will close your case and your spouse would have to start over from outside the country.
What is the difference between I-485 and consular processing? β€Ί
Consular processing is for spouses outside the US , they apply for an immigrant visa at a US Embassy abroad and enter the US as a permanent resident. Adjustment of status (I-485) is for spouses already inside the US , they apply to change their status to permanent resident without leaving. I-485 has higher government fees ($1,440 vs $675) but avoids the visa interview abroad and keeps your spouse in the US throughout the process.
Do both spouses attend the I-485 interview? β€Ί
Yes. Unlike consular processing where only the spouse attends, adjustment of status interviews require both the US citizen petitioner and the foreign national spouse to appear together at a local USCIS field office. The officer will ask both of you questions about your relationship. ClearPath interview prep covers exactly what adjustment of status officers ask.
What if my spouse overstayed a visa before we got married? β€Ί
Immediate relatives of US citizens (including spouses) are generally not subject to the 3-year and 10-year bars for visa overstays when adjusting status inside the US. However, this is a complex area of immigration law and every case is different. ClearPath is a document preparation service and cannot give legal advice. If your spouse has a visa overstay history, we strongly recommend consulting a licensed immigration attorney before filing.
